Each Day Of The Year And What Contact The Child Shall Have With Each Party

PARAGRAPH 3.1--CHILDREN FOR WHOM SUPPORT IS REQUIRED. Provide the first and last name and the age of each child for whom support is required.

PARAGRAPH 3.2--PERSON PAYING SUPPORT (Obligor). Provide the information requested. List the information for one of the parent(s)-respondent(s) ordered to pay child support. For the service address, you may list an address that is not a residential address where the person paying support agrees to accept legal documents. If the person paying support is a victim of domestic violence, you can use an address where it will be safe for the person paying support to receive legal documents. You can reach a local domestic violence social service agency for assistance on this matter by calling the statewide Domestic Violence Hotline at (800) 562-6025 or CLEAR (888) 201-1014.

If the income of the person paying support is unknown, or the person is either voluntarily unemployed or underemployed, the court must impute income to that person. Read the instructions to the Child Support Worksheet for an explanation of imputed income.

PARAGRAPH 3.3--PERSON RECEIVING SUPPORT (Obligee). Provide the information requested. List the information for the person(s) ordered to be the child(ren)’s custodian. For the service address, you may list an address that is not a residential address where the person receiving support agrees to accept legal documents. If the person receiving support is a victim of domestic violence, you can use an address where it will be safe for the person receiving support to receive legal documents. You can reach a local domestic violence social service agency for assistance on this matter by calling the statewide Domestic Violence Hotline at (800) 562-6025 or CLEAR (888) 201-1014.

PARAGRAPH 3.4 -- SERVICE OF PROCESS. This paragraph contains important information about service of documents.

PARAGRAPH 3.5--TRANSFER PAYMENT. Using the applicable box, list the paying parent’s transfer payment ordered by the court. Make sure that either the first or the second box is checked and the blank lines are completed. Check the third box if the combined monthly income of the paying parents exceeds $7,000 and the court sets child support in excess of the advisory amount. Explain why child support is set in excess of the advisory amount. Check the fourth box if you wish to have the support amount adjusted when a child changes from age bracket A to age bracket B on the Child Support Schedule or if support terminates. If the fourth box is checked explain how support should be adjusted.

PARAGRAPH 3.6--STANDARD CALCULATION. Enter the amount listed for the paying parent on line 15 of the Child Support Worksheet.

PARAGRAPH 3.7--REASONS FOR DEVIATION FROM STANDARD CALCULATION. Check the box that applies. (A "deviation" means the child support is higher or lower than the amount listed on line 15 of the Child Support Worksheet.) If the amount of child support ordered at paragraph 3.5 is the same as the amount listed at paragraph 3.6, check the first box. If the amount of child support ordered at paragraph 3.4 is different (i.e., deviates) from the amount listed at paragraph 3.6, check the second box and then check the boxes below which apply. You must also explain the facts that support these reasons checked.

PARAGRAPH 3.8--REASONS WHY REQUEST FOR DEVIATION WAS DENIED. Check the first box if the court granted a deviation. Check the second box if neither parent requested an amount of support that was different from the amount listed on line 15 of the Child Support Worksheet. Check the third box if an amount of support was requested which was different from the amount listed for the paying parent on line 15 of the Child Support Worksheet, but the court did not grant the deviation and the amount of support in paragraph 3.5 is the same as the amount of support listed for the paying parent on line 15 of the Child Support Worksheet.

PARAGRAPH 3.9--STARTING DATE AND DAY TO BE PAID. Provide the information requested.

PARAGRAPH 3.10--INCREMENTAL PAYMENTS. Check the first box to show this does not apply. Check the second box if this is a modification of previously ordered child support and the obligation has been modified by more than thirty (30) percent and the change would cause a significant hardship. The person paying support may pay the increase in two equal increments, the first at the time the order is entered and the second six months later. Write the date the second increment will be due in the space provided.

PARAGRAPH 3.11--HOW SUPPORT PAYMENTS SHALL BE MADE. Check the first box if you want the Division of Child Support to collect and distribute the child support payments and provide enforcement services. Check the second box if you do not want the Division of Child Support to provide enforcement services. If you and the paying parent have worked out a payment plan, use the third check box to write your payment arrangements. Use the forth check box if you want the Division of Child Support to process payments.
